Legal cases
Mount Cathay Pty Ltd and Chiu Fan Lee have been involved in court and tribunal proceedings since the 1980s. The summary below is grouped by theme. The civil-court matters are drawn from a party search of the Queensland Supreme and District Court civil files (“Mount Cathay”), which returns fifteen records spanning 1992–2024; the principal files are grouped below. Electronic court records began at different dates, so earlier matters and other forums are listed separately.
The stalled sale and redevelopment (2019–2026)
The largest cluster of litigation surrounds the attempted sale and redevelopment of the site and the collapse of the Millinium deal (see the 2013–2020 and 2021–2026 timelines).
- 1883/20 — Arkhefield Pty Ltd v Millinium Capital Managers (District, 2020), a “money owing” claim by the project architects.
- 8947/22 — 1480 Logan Road Pty Ltd & Waltons Emporium Pty Ltd v Chiu Fan Lee, Nancy Lee & Mount Cathay (Supreme, 2022), the purchaser side’s claim over the disputed transaction.
- 5275/23 — Mount Cathay v 1480 Logan Road Pty Ltd (Supreme, 2023); dismissed by Kelly J on 12 June 2023.
- 9955/23 — Mount Cathay v Millinium Capital Managers (Supreme, 2023); resolved by consent (Callaghan J, 8 September 2023).
- 10415/23 — Millinium Capital Managers (as responsible entity of the Jaga Alternative Income Fund) v Mount Cathay & Waltons Emporium (Supreme, 2023).
- 485/24 — Juniper & LaSalle Investment Management v Brisbane City Council (Planning & Environment Court, 2024), with Mount Cathay as co-respondent, challenging the development approval; discontinued on 21 May 2024.
Both 8947/22 and 10415/23 remained on the Supreme Court’s Commercial List (Hindman J) into 2026.
Valley Metro underground-access dispute (2020–2023)
- 11907/20 — Mount Cathay & iLife Factory v The Trust Company Limited & Buildcorp Group (Supreme, 2020), a damages claim over alleged trespass and interference with Mount Cathay’s leased underground access tenement during works near the Fortitude Valley station. Tried before Bradley J and dismissed with costs in Mount Cathay Pty Ltd & Anor v The Trust Company Ltd & Anor [2023] QSC 102 (17 May 2023); iLife Factory was found to lack standing.
Lend Lease and body-corporate disputes (2010–2013)
- 2307/10 — Bazan & another v Body Corporate for McWhirters Retail Community Title Scheme 34719 & others (District, 2010).
- 1670/12 and 3506/12 — Mount Cathay and Lend Lease Funds Management Limited (Supreme, 2012), cross-proceedings later taken to the High Court, where Mount Cathay’s special-leave application was dismissed in February 2013. Costs were litigated through 2013.
Winding-up applications against Mount Cathay
Creditors have twice sought to wind up Mount Cathay; both attempts failed.
- 10544/13 (2013) — dismissed, with a final order in January 2014.
- 8743/21 — an Eventus Lawyers creditor’s application (2021), discontinued within weeks.
Older and personal-injury files
- 2675/00 — Brown v Mount Cathay & others (District, personal injury, 2000).
- 3398/97 — Briggs v Endicastle Pty Ltd & others (District, personal injury, filed 1992).
Matters outside the civil-files search
- 1988 — Mount Cathay v Waltons Stores (Interstate), Norman Ross Stores and Venture Stores (Retailers). A writ (Queensland State Archives Item ID 1024937, departmental no. 2228/88) filed soon after the department-store tenancy ended — the earliest recorded dispute over the building.
- 2014 — Queensland Civil and Administrative Tribunal. QCAT refused a stay of a Queensland Fire and Rescue Service decision against Mount Cathay over fire-safety defects.
